Directors' and Officers' Liability for Texas Client State Agencies

September 14, 2010 - Announcing the renewal of the statewide program for Directors’ & Officers’ Liability (a.k.a. Public Official Liability) insurance coverage with Employment Practices Liability to all state agencies and institutions of higher education. All agencies renewing your current policy or considering the purchase of this line of insurance coverage are required per the Texas Labor Code, Section 412.011 to participate in this program.

Arthur J. Gallagher Risk Management Services will continue to provide this program with coverage by ACE USA. More information is available under the September 14, 2010, announcement. Procedures to obtain a quote and then coverage are as follows:

  1. Complete the appropriate application.
    1. Colleges, Universities and Healthcare Operations complete the ACE Express Application (PDF, requires free Acrobat Reader) or Word.
    2. All other state agencies complete the ACE Public Entry Application (MS Word).
       
  2. Submit the completed application, along with the most recent Annual Financial Report and Employee Handbook, to State Office of Risk Management (SORM), Bonds & Insurance Section, P.O. Box 13777, Austin, TX 78711-3777.
     
  3. SORM will review and submit application to insurance agent, Arthur J. Gallagher, to obtain quote from insurer, ACE.
     
  4. Upon receiving the quote, SORM will forward to agency or institution for consideration. Any questions should be addressed to the Bonds & Insurance Section via e-mail bonds.insurance@sorm.state.tx.us.
     
  5. If coverage is desired, agency prepares purchase order
    1. Referencing Contract #479-2-2061.
    2. Posting notification on Texas Marketplace, if premium is over $25,000.
    3. Payable to Arthur J. Gallagher, Vendor #75-1317623.
       
  6. A binder and invoice will be sent from Arthur J. Gallagher to the agency.

It will take approximately 10 days for SORM to process the application, and an additional 30 days to receive a quote, so please allow sufficient time for processing.
